1. Provider and scope

  1. Lectio is provided by Mateo Arenas Salas, Spreestraße 5, Flat 5130, 64295 Darmstadt, Germany, email: mateoas@icloud.com ("we"). See the legal notice for more details.
  2. Lectio is free. We charge nothing for the app or its online services.
  3. You get Lectio from Apple's App Store. Apple's standard Licensed Application End User License Agreement applies alongside these terms. These terms supplement it; where the two conflict, these terms prevail as far as Apple allows.
  4. Our privacy policy explains how we process your personal data.

2. The service

  1. Lectio is a semester planner: semesters and courses with readings, tasks and other items, a class schedule with attendance, a study timer with study time, and credits and grades across all semesters. Without a user account, Lectio stores your data only on your device.
  2. With an optional user account, Lectio syncs your data between your devices. With a username, you can also add friends and share your class schedule with them (sections 4 and 5).
  3. Optionally, you can connect Lectio to your university's Moodle and, as a student of TU Darmstadt, import grades and credits from TUCaN (section 8).
  4. We keep developing Lectio and may change, add or discontinue features where this is reasonable for you. You have no claim to any particular feature.

3. User account

  1. The user account is optional. You create it with an email address and password, with Sign in with Apple or with a Google account.
  2. You must be at least 16 years old to have a user account.
  3. A user account belongs to exactly one person. You may not share, transfer or sell it. You may not create a user account to get around a suspension, a deletion by us or a block by other users.
  4. Give true information when you sign up, and use only an email address that is yours. Keep your sign-in details secret and tell us if you suspect someone is misusing your account.

4. Username

  1. A username is optional. Without one, nobody can find you, and you cannot add friends.
  2. Your username is visible to other signed-in users who search for it, whom you send a request, or who are your friends. It must not
    • be insulting, obscene, discriminatory, glorify violence or be otherwise offensive;
    • suggest that you are another person, a university, a company or Lectio itself;
    • infringe the rights of others, in particular name or trademark rights;
    • contain contact details such as email addresses or phone numbers, or be used for advertising.
  3. The app refuses offensive usernames where it recognises them. We may remove a username that breaks paragraph 2 at any time; you can then choose another.

5. Friends and schedule sharing

  1. You can send other users a friend request by their username. Once they accept, each of you sees the other's class schedule, as far as each of you allows under "What Friends See".
  2. Only classes are shared (lectures, exercise groups, exams and other classes) and, depending on your settings, their names, rooms and notes. Attendance, readings, tasks, grades, credits and study time are never shared.
  3. You may look at your friends' schedules only for yourself. You may not pass them on, publish or collect them, or use them to stalk or harass anyone. Don't write anything in shared notes that your friends shouldn't see.
  4. You can withdraw a request and remove a friend at any time. Sharing then ends in both directions.

6. Rules of conduct and zero tolerance

  1. We have zero tolerance for objectionable content and abusive users. In particular, you may not use Lectio, for example through usernames, friend requests, shared notes or reports, to
    • harass, threaten, insult, intimidate or stalk others;
    • spread hateful, discriminatory, pornographic, violent or otherwise unlawful content;
    • pretend to be another person or organisation;
    • send spam, unwanted requests in bulk or advertising;
    • overload the services, query them automatically or get around security measures, or collect other users' data;
    • file reports you know to be false.
  2. You can block and report any other user from the "…" menu on their row in your friends list or on their request. A block ends your friendship and every request between you; the blocked user can no longer find you or send you requests and is not told about the block. You can also report a violation to us by email.
  3. We review every report within 24 hours. Where we find a violation, we remove the objectionable content and, depending on how serious it is and without prior notice if need be, may remove the username, suspend the user account or delete it, and so remove the user from Lectio. In the case of criminal offences, we may inform the authorities.
  4. In choosing a measure, we take the legitimate interests of everyone involved into account. We tell the affected user about the measure and its reason by email, unless protecting others prevents it, and they can reply to us. They are never told who reported them.

7. Your content

  1. What you enter in Lectio, such as semesters, courses, items, notes and your username, stays yours.
  2. You grant us the simple, free and non-transferable right to store and copy your content, sync it between your devices and show it to your friends as far as you choose, and only as far as running Lectio requires. This right ends when you delete the content or your user account.
  3. We do not use your content for advertising, and we pass it on only to the service providers named in the privacy policy.
  4. You are responsible for your content and may only add content you have the necessary rights to.

8. Moodle and TUCaN

  1. Connecting Moodle and importing from TUCaN are optional. Moodle and TUCaN are run by your university, not by us. Lectio is not a service of your university, TU Darmstadt or Moodle, and is not affiliated with any of them.
  2. You are responsible for following your university's rules for Moodle and TUCaN, in particular their terms of use. You sign in with your own credentials and retrieve only your own data.
  3. What Lectio takes from Moodle or TUCaN is a copy for your personal use. It is not an official document or proof towards your university or anyone else, and it may be incomplete or wrong, for example when your university changes its pages. Only your university's own records, such as your transcript of records, are authoritative.
  4. What Lectio calculates, such as grade point averages, weightings, credits, progress and the assignment of modules to areas, is a non-binding aid without guarantee. It depends on your input and settings and need not match your examination regulations. Check anything that matters against your university's official records.

9. Availability

  1. We try to keep Lectio and its online services available and free of errors, but we do not guarantee any particular availability. Maintenance and outages at our service providers or on the internet may interrupt the online services. Without a connection, the app keeps working with the data stored on your device.
  2. Reminders, timer alarms and widgets depend on your device and its settings. Don't rely on them alone for important deadlines.
  3. Back up important data yourself, for example by exporting it as a ".lectio.json" file.
  4. We may discontinue the online services. We will announce this early enough for you to export your data.

10. Liability

  1. We provide Lectio free of charge. We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, for defects we fraudulently concealed, and under the German Product Liability Act.
  2. Otherwise our liability is excluded as far as the law allows. This applies in particular to data loss, missed deadlines and wrong calculations or imports.
  3. These rules also apply to the liability of the people who help us. Mandatory statutory liability, for example under the General Data Protection Regulation, is unaffected.

11. Account deletion and termination

  1. You can stop using Lectio and delete the app at any time.
  2. You can delete your user account at any time in the app: Profile ▸ your account's row ▸ "Delete account…". This deletes your user account and the data stored with it, as described in the privacy policy. Data on your device stays. You can also ask for the deletion by email.
  3. We may end the use of a user account with 30 days' notice by email.
  4. For good cause, in particular for serious or repeated breaches of sections 3 to 6, we may suspend or delete a user account immediately (section 6 paragraph 3).

12. Changes to these terms

  1. We may change these terms for the future where there is a valid reason, such as new features, a change in the law or security, and the change does not unreasonably disadvantage you.
  2. We will tell you about changes in the app or by email at least four weeks before they take effect. If you don't agree, you can delete your user account before then. If you keep using the online services after the changes take effect, the changed terms apply; we will point this out in the notice.

13. Applicable law

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not take away the protection of the mandatory provisions of the country where you habitually live.
  2. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
  3. If any provision of these terms is invalid, the rest remain valid.

14. Apple

  1. These terms are between you and us only, not Apple Inc. We, not Apple, are responsible for Lectio and its content.
  2. Apple has no obligation to provide any maintenance or support for Lectio.
  3. If Lectio fails to conform to an applicable warranty, you may notify Apple, and Apple will refund any purchase price, which for Lectio is nothing. Beyond that, to the extent permitted by law, Apple has no warranty obligation with respect to Lectio.
  4. We, not Apple, are responsible for addressing any claims relating to Lectio, such as product liability claims, claims that it fails to conform to a legal or regulatory requirement, claims under consumer protection or privacy law, and claims that it infringes the rights of others.
  5. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
